1. Acceptance of Terms

By accessing or using Testimark (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Testimark provides AI-powered testimonial collection, management, and display tools for service professionals. Features include collection pages, testimonial management, AI content generation, and embeddable widgets.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscriptions & Billing

Paid plans are billed monthly or annually through Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period. We offer a 30-day money-back guarantee for new subscribers.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Submit or solicit fake testimonials
  • Attempt to access other users' data or reverse-engineer the Service
  • Send spam or unsolicited messages through the testimonial request system
  • Violate any applicable laws, including anti-spam legislation

6. Content Ownership

You retain ownership of all content you submit to or generate through the Service, including testimonials and AI-generated content. You grant Testimark a limited license to store, process, and display your content as necessary to provide the Service.

7. AI-Generated Content

Content generated by our AI features (request emails, social posts, case studies) is provided as suggestions. You are responsible for reviewing and editing AI-generated content before use. Testimark does not guarantee the accuracy or appropriateness of AI-generated content.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability.

9. Limitation of Liability

Testimark is provided “as is” without warranties of any kind. Our total liability is limited to the amount you paid in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, you may request an export of your data within 30 days.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance.
